what if you went through a diversion program for a crime you commited/ will that show up on a criminal background check ?

In terms of employment purposes, the general rule is 7 years. If the employer is utilizing a 3rd party agency, called a consumer reporting agency, then they are required to follow the Fair Credit Reporting Act. If this is the case, and the diversion program is over and there was never a conviction, then that record should not be returned by the CRA. It will still exist and can be found by conducting a court record search, however, it may violate that particular section of the FCRA. Additionally, there are 14 states that have a stricter interpretation of the FCRA, and again a differed case should not be utilized.
